TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to licensees of the Australian PorkMark program with or without multiple outlets in Australia (“entrants”).
3. There are two (2) categories in the promotion. Only one (1) entry permitted per entrant per category.
4. Registrations close 5pm AEDST on 22 January 2010 (“Registration Period”).
5. To enter, the entrant, must during the Registration Period, complete and send in the entry form in accordance with the directions. The entrant will then be contacted by the Promoter and provided with an entry number. The entrant will then be required to submit their bacon products by 3 February to the address nominated by the Promoter.
6. The bacon products submitted as part of the entrant’s entry must comply with the following requirements: (a) the bacon products must be made on the premises of the entrant, by the entrant or his/her staff; (b) the bacon products must be available for purchase and not specifically made for the purpose of the promotion; (c) the bacon products must be identified by their product name and entry number only, on a sticky label placed on the packaging of each pack, and must not contain the business name. If the product name normally includes the business name then the entrant must only include the product name without the business name; (d) the bacon products must only include pork from animals produced in Australia; (e) all entries must consist of two (2) vacuum packs of 400grms (or a minimum of eight rashers in each pack) per entry and without garnish; and (f) all entries must arrive chilled and be in suitable and hygienic packaging. The Promoter will not judge bacon products that do not arrive in a suitable condition. It is the entrant’s responsibility to ensure that the bacon submitted arrives in a suitable fashion.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Incomplete, indecipherable, or illegible entries will be deemed invalid. Bacon products will be deposed of and not returned to the entrant after the conclusion of judging.
9. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on raw and cooked form. In the case of raw form it will be judged on appearance, lean to fat ratio, cure process, and general texture. In the case of cooked form it will be judged on aroma, shrinkage, texture & moisture, and taste. The judges’ decision is final and no correspondence will be entered into.
10. The entrant with the most points overall, after the conclusion of judging, will be deemed the overall winner. For the sake of clarity, the Promoter will assess the points awarded to the entrant in each category to assess their overall score. The overall winner will be announced at the launch event for National Bacon Week. In addition the overall winner will receive the prize of being announced in a radio advertisement that will be aired in the winner’s State or Territory for the duration of up to a week, at times and on a station(s) as determined by the Promoter in its absolute discretion. The radio ad will also make reference to the Australian PorkMark program and National Bacon Week. The content of the radio ad will be determined by the Promoter in its absolute discretion.
11. The entrants who submitted the entries which achieved the most points in each category will be deemed the category winners and receive the prize of a trophy.
12 In addition to the radio ad for the overall winner, entrants consent to the Promoter using the entrant's name in the event they are a winner in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and the Australian PorkMark program.
13. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
14. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or correspondence that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; and (c) in connection with a prize.
15. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
